These terms cover the use of the yolostore.nz website, ordering, payment, delivery and returns at YOLO Store Limited. They are effective from 18th February 2018 and may be updated from time to time. You are deemed to have accepted these terms and conditions when you visit the yolostore.nz website and purchase goods.
PRODUCT INFORMATION AND AVAILABILITY
We have made every effort to show an accurate price and description of the products featured on our website. If there is an error in the website price then we reserve the right not to fulfill orders at that price. We may update any product information, including the price, at any time and for any reason, without prior notice.
We cannot guarantee that the colour, texture or detail of a product viewed on your screen or device will accurately reflect the actual product.
Any measurements provided on our website are approximate only.
We will attempt to exclude any product which is unavailable from the website and show accurate stock levels against products. If a product ordered by you from our website is no longer available, we may cancel and refund your order. Alternatively, we may advise you of the estimated date the product will be available. You may opt to wait until that time to have your order fulfilled. We will not be liable to any person if we are unable to fulfill, or decline to fulfill, an order.
PRICING AND PAYMENT
Prices on the website are displayed in New Zealand dollars, inclusive of goods and services tax (GST).
Payment can be made by direct credit to our nominated bank account or online by Visa or MasterCard credit or debit cards. A layby payment option is also available – see the Layby Terms & Conditions for details.
If we suspect that a credit or debit card payment is fraudulent, we may, at our sole discretion, cancel the order and refund the payment.
You will be required to pay a delivery fee of $4.00 per order (which may include multiple items) for purchases made from our website. If you have a rural address you will be required to select the rural delivery option on the cart checkout page and pay an additional $4.00 per order. If you have a rural address and you do not select the rural delivery option, you will be required to pay the additional $4.00 charge before your items will be shipped to you.
We reserve the right to charge additional delivery fees for orders that we deem to be over-sized.
We will endeavour to deliver goods ordered from our website which are in stock within a maximum of 3 business days from the date we receive and process your order. Rural deliveries may take longer than 3 days in some areas. If we anticipate that there may be a delay, we will advise you of the expected delivery time and give you the option to confirm or cancel the order. We will not be liable for any delays in delivery of goods.
Pre-order items have an estimated delivery time of between two and four weeks from the date we receive your order. You will be contacted if there is an unexpected delay.
If you order both in-stock and pre-order items within the same order, your in-stock items will not be delivered until your order is complete i.e. until your pre-order items have arrived. If you wish to have your in-stock items delivered immediately, you will need to order these separately from pre-order items.
If you have not received delivery of your order, please contact us within 5 business days of when delivery was expected. We will lodge a claim against our courier service provider and will offer you a replacement item or a full refund, once we receive confirmation from our courier company that delivery was unsuccessful.
If for any reason you are not happy with your YOLO Store purchase you may return it for your choice of either a full refund of the purchase price or a replacement item, subject to the following:
- The item must be in the original new, unworn condition
- You must return the item within 30 days of receiving it
- You are responsible for the cost of returning the item
- The details of the original order must be provided with your return, including the name and address supplied
Delivery charges are non-refundable. Refunds will be processed within 10 business days of receipt of the returned item.
CONSUMER GUARANTEES ACT
If the product is of a type ordinarily acquired for personal, domestic or household use, the Consumer Guarantees Act 1993 may apply. If this Act applies, all rights you may have under it apply in addition to the rights you have in this Agreement. Nothing in this Agreement will limit or exclude your rights under this Act.
Where you acquire our products for the purpose of a business, then the Consumer Guarantees Act 1993 will not apply.
To the extent permitted by New Zealand law, YOLO Store excludes all warranties (whether express or implied). We will not be liable for any loss or damage of any kind incurred by you. You are responsible for your action or inaction based upon advice, opinion or representation, whether negligent or otherwise, provided on this site.
This Agreement is deemed to be made in New Zealand and shall be subject to the laws of New Zealand.
